Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Smart Trend Club (the “Application”), an email outreach and campaign management tool that connects to your Gmail account via the Gmail API. By authorizing and using the Application, you agree to these Terms.

1. Description of the Application

Smart Trend Club is an internal email automation tool that helps authorized account owners send scheduled outreach emails, manage follow-up campaign sequences, and track recipient replies through their own Gmail account.

2. Eligibility & Access

The Application is not available for public registration. Access is restricted to individually authorized users who connect their own Google account and grant explicit permission through Google’s OAuth consent screen. By connecting your account, you confirm that you are authorized to grant this access.

3. Your Responsibilities

• You will only use the Application to send legitimate outreach and follow-up communications that comply with applicable law, including anti-spam regulations.
• You will not use the Application to send unsolicited bulk email, phishing content, or any communication that violates Google’s Acceptable Use Policy or the Gmail API’s usage restrictions.
• You are responsible for the accuracy of the content sent through your authorized Gmail account.
• You will keep your account credentials confidential and notify us promptly of any unauthorized use of your account.

4. Google Account Access

The Application accesses your Gmail account only through Google’s secure OAuth authorization flow, using the following scopes:

• gmail.send — to send outreach and follow-up emails on your behalf.
• gmail.readonly — to detect recipient replies and pause follow-up sequences automatically.

You may revoke this access at any time through your Google Account Security settings.

5. No Guarantee of Deliverability

We do not guarantee that emails sent through the Application will be delivered, opened, or replied to. Email delivery is subject to factors outside our control, including recipient mail servers and spam filters.

6. Data Use

Our collection and use of information from your Google account is governed by our Privacy Policy, which is incorporated into these Terms by reference. We do not sell, share, or use your Google user data for advertising.

7. Prohibited Uses

You may not use the Application to:

• Send spam, phishing messages, or malicious content;
• Violate any applicable law or third-party right;
• Interfere with or disrupt the integrity or performance of the Application or the Gmail API;
• Attempt to gain unauthorized access to any account, system, or network connected to the Application.

8. Termination

You may stop using the Application and revoke access at any time. We may suspend or terminate your access to the Application if we believe, in good faith, that you have violated these Terms or misused Google user data.

9. Disclaimer of Warranties

The Application is provided “as is” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, Smart Trend Club shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue arising from your use of the Application.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. Continued use of the Application after changes constitutes acceptance of the updated Terms.
